Does anyone know what is the current count on H1-B Visas left for the year 2006-07 ?
I know I may sound stupid and probably the answer is that it is already complete, but wanted to confirm.
Also, when would the next years quota become available and when can one start working at the earliest ?
Is there any other way to file for H1-B now and work..?

Due to Iceland's volcanic ash my MIL trip has to be postponed. She was on visitor visa. We filed an extension with USCIS and paid $300. She left US as soon as flights started to resume.
USCIS approved her extension 30 days after she left US.
a) Can we seek a refund because this extension has to be filled due to reasons beyond our control
b) In the future how to seek a fee waiver (any tips or advice please).
c) Can we seek fee waiver when we e-file a petition.

I had similar situation few years back after my I-140 approved, but before applying I-485.
As long as your job title, description and place of work won't change, then you are ok. When you apply I485 or H1B ext, then your attorney must submit a document (successor of interest or similar document), telling that your role and place don't change.

I'm from the Philippines and Mar. 28, 2006 is my PD. My question now is, what if by June (by God's grace) my PD will be processed. How many more months should I wait before receiving my packet 4? considering that certain documents (ds230,nbi) need to be updated & be sent to them. A total of how many more months should I still need to wait before my embassy interview?

I have question to you. I am July 2007 filer. My EAD and My wife EAD expiring on 09-25-2008. I applied both renewal Yesterday(06-24-2008 -90 days before).
recently My wife moved from H1B and working on EAD ( I am still working on H1B).
1. If we wont get EAD cards in time (i.e. before 09-25-2008). What will be her status after 09-25-2008 ?
2. Can she change back to H4 or can she change back to H1?
Please advice me.

Great Analysis from AILA to share with our readers. PL 111-230 requires the submission of an additional fee of $2,000 for certain H-1B petitions (http://www.h1b.biz/lawyer-attorney-1137085.html) and $2,250 for certain L-1A (http://www.h1b.biz/lawyer-attorney-1137416.html) and L-1B petitions postmarked on or after August 14, 2010. Petitioners subject to this new fee include employers with more than 50 employees in the U.S., for which 50% of their workforce is on H and L visas. The fee will remain in effect through September 30, 2014.
USCIS indicated that Vermont Service Center and California Service Center were instructed to hold any H or L petitions sent after that date, pending guidance on how to determine whether the petitioner is subject to the new fee. My cousin is getting married to a US citizen in February 2009. I want to get information about K3 visa for spouse of US citizen. My questions are:
1. I have heard that it takes long time to get K3 visa, is that true?
Yes it is true that the K3 visa may take a year and the spouse must remain in the home country during that time.
2. If the above statement is true then what other visa option is best for her, visitor or fiance visa (K1 visa)?
She can try for K1 visa but it must be filed now and she must come to the US before marriage. The K1 visa processing can take a few months so your cousin may be running out of time.

I filed my EAD online for the first time on May 9th. Yesterday I got an approved card for my wife and I. It is interesting how fast that came and that I did not need to send pictures nor did I go for fingerprinting. My initial finger printing and picture taken for 485 was used to give me the EAD
However, NSC issued the EAD for 1 year only. I called up help desk and asked them why 1 year and not 2 years. They checked their records and saw I was eligible for 2 year, then they transferred me to Level 2 support. The Level 2 support after looking at my case, put me on hold for sometime and then came back and said, the period of EAD was done at the discretion of NSC. So if I do not want it, I should send it back and ask them to reopen my case.
Guys any advise or should I wait for 1 year and hope next year they will issue a 2 year EAD?? I really do not want to send my EAD back...

If she goes out of the country and enters back using her H4 stamping, she will be on H4.
If she intends to work, she will have to either apply for Change of Status from H4 to H1 or needs to go for H1 stamping and enter US using that stamp.

Hi, Please let me know your thought on my situation. I was on H1 thru Company A. I don't have pay stubs for the last 3 months of 2005 since i was on bench, but got the salary that is mentioned on LCA in pay stubs till end of Sept. When I asked my employer to pay me for the time on bench he said that he has paid the LCA salary and doesn't have to pay.
So having said that, am I in Status or Out of Status?
If the W-2 is for more than the LCA requirement, you don't have any thing to worry about.

I currently have my 485 & AP numbers but do not have I-140 number to track on the USCIS website.
