Hello,
I have recently moved from Company A(where I worked for 6 years of which last 4 years was in US on H1B) to Company B(working here for 6 months). My H1B transfer is complete but my VISA needs stamping. I need to travel to UK for 2-3 days next week.
Am I eligible to get the Visa stamping done in London? If so, is this a high risk option? How do you compare the risk of the option with the risk of alternate in making a trip to India from UK to get my Visa stamped? Does the fact that my current job is with a smaller(200 to 500 employees) IT consulting firm add to the risk significantly?
Do you think it is possible to get stamping dates around Dec 12-13?
In case VISA gets rejected in UK, what are the chances I can go back to India and get it stamped after that? And how long will that take on average?

how is it possible to change jobs while the GC application is pending (part of the July 07 madness). Supposedly there is the AC21 form, is there an example how this form should be filled, and what other documents should be included? How long does it take to approve? (for driver's license, traveling, etc.). Does it have to be filed with H1B extension?
The new job offer is 25% pay increase, otherwise very similar, could that be a problem?

In my case i am a consultant, and keep on moving like 8-9 months....... dont have any permanent address.............. i am sure a lot of ppl will be in the same position as i am............. so what are you guys doing for the addresses on the 485/EAD/AP..........
AFAIK, You can file AR 11 online. Once you are done with filing AR11, it will ask you all the applications on file with USCIS. If you give your receipt numbers, it will update the address associated with those applications.
To avoid any confusion as of now, (if your 485 and 693 has different addresses) attach an addendum explaining why you were medical was done in FL, while your permanent address is out of the DC area.
Just my thoughts, talk to your lawyer and see what he will say.

Hi,
I graduated on May 2008 with an MBA degree. My OPT started in Jul 2008 and is valid till Jul 2009. I am not eligible for 29month extension.
I was on an internship till Jan 30th 2009 and am looking for fulltime positions now.
I understand that I will have to file for H1 on April1st and I can stay in the US and work legally if my H1B is still in process under the cap-gap rule passed last year.
How long can I legally stay in the US on OPT without a job?
Can anyone please throw light?

Don't be so harsh Kumar. This whole process is so troublesome and some times illogical, you get all kinds of doubts, especially when you are working with a short time line. (S)He did not mention getting a green card for them but going through medicals.

EB3 is an overloaded ship, either you had to abandon(read porting to Eb2) or unload few of them (removing 245(i) cases from Eb3) to reach the target.
Abandoning can take an year for most of us - PERM Approval time line for now.
Unloading will never happen in this economic scenario

We have organized an Immigration Voice booth this Saturday August 18th at Pierce College, Woodland Hills at the IALA (India Independence) event. 14,000 people attended this event last year. Our aim is to talk to the general public about our issues, increase our membership and to generate publicity for the DC Rally. We will be handing out printed material, giving presentations and discussing our issues with the public.
The booth will be open from 3pm to 11pm. Come volunteer at the booth or visit us on the day. For more information on how you can volunteer, join the Southern California chapter here:

1. My colleague crossed 2 years after filing 485. Frustrated with GC processes, he is switching company for better career prospects. He is using his EAD and invoking AC21. Is it possible for me to use his labor? If no, why?

H-1B Visa Employer that Does Not Effect a �bona fide termination� under the H-1B provisions Liable for back wages to H-1B Employee.
To employ H-1B visa nonimmigrants, an employer must fill out a Labor Condition Application (LCA). The LCA stipulates the wage levels that an employer guarantees for the H-1B visa worker�s pay. In signing and filing an LCA, an employer attests that for the entire �period of authorized employment,� the required wage rate will be paid to the H-1B nonimmigrant.
An employer need not compensate a nonimmigrant, however, if it has effected a �bona fide termination� of the employment relationship. To ultimately effectuate a �bona fide termination� under the INA, an employer must notify USCIS that it has terminated the employment relationship with the H-1B nonimmigrant employee so that USCIS may revoke approval of the H-1B petition. The employer must also provide the employee with payment for transportation home. Failure to do so may subject the employer to liability for back wages to the H-1B employee.
In Amtel Group of Florida v. Yongmahapakorn, Amtel provided notice to the H-1B visa employee that it had terminated the employment relationship. Amtel Group of Florida v. Yongmahapakorn, 04-087 (ARB 9/29/06). However, the court held that notice alone was not sufficient to end the employer�s obligation to pay the required wages to an H-1B employee. The employer does not effect a �bona fide termination� and, therefore, end its obligation to pay the required wages to the H-1B employee unless the employer has also notified USCIS. The court therefore ordered Amtel to pay the employee the prevailing wage for an internal auditor until the expiration of her authorized period of stay for H-1B employment, plus prejudgment compound interest on the back pay owed and post judgment interest until the employer made full payment.

my colleague had same problem. Employer is a big bank. He called USCIS customer service at Vermont and they said they can see it and they told him it is ok if he dont see it online. He was not sure, took infopass and they also said same thing. But, after infopass, a week after that it showed up online. Not sure if that has anything to do with it.
